On 7 April 2026, FinCEN published a Notice of Proposed Rulemaking that would change how anti-money laundering and countering the financing of terrorism programmes are judged. Docket FINCEN-2026-0034 does not simply ask examiners to confirm a programme exists on paper.

It asks whether that programme actually works, whether transaction monitoring rules surface genuine suspicious activity rather than alerts that lead nowhere, and whether resourcing decisions hold up against a documented risk assessment.

For risk leaders overseeing monitoring across several business lines and legal entities, that is not a compliance footnote. It is a governance question: can the organisation show, end to end, that its monitoring architecture produces outcomes rather than paperwork.

The proposed rule asks institutions to show one documented line from risk assessment, through monitoring rules and case outcomes, to independent testing and group-level oversight.

Quick answer

FinCEN’s proposed rule, published on 7 April 2026, would judge AML/CFT programmes on whether they work in practice, not just whether they exist. Examiners would test whether monitoring surfaces genuine suspicious activity and whether resourcing holds up against a documented risk assessment, which makes consistent, evidenced monitoring across every affiliated entity a group-level governance issue.

From programme existence to programme effectiveness

The NPRM keeps the traditional four pillars intact: written policies, procedures and controls; independent testing; a designated compliance officer; and training. What changes is how those pillars are judged. FinCEN’s proposal separates “establishing” a programme, putting the required elements in place, from “maintaining” it, implementing that programme in all material respects. Examiners would be expected to assess whether an institution’s resource allocation is informed by, and consistent with, a reasonably designed risk assessment, and whether the institution knew or should have known about resourcing issues that could cause the programme to fail in practice.

The comment period on the NPRM closed on 9 June 2026, and if the rule is finalised as proposed it would take effect twelve months after issuance. That runway matters. It gives institutions a defined but finite window to close the gap between a programme that exists and one that can withstand an effectiveness test.

The four pillars are unchanged:

Policies, procedures and controls

A risk-based set of controls that is reasonably designed to ensure compliance.

Independent testing

Judged on whether the programme is effective, by parties genuinely independent of the AML/CFT function.

Designated compliance officer

A required element, substantially unchanged from today’s rule.

Training

A required element, carried over from the existing programme rule.

Why this becomes an enterprise problem rather than a single-desk one

Groups that combine a bank, a broker-dealer, a money services business or a card-issuing arm under one ownership structure now face a consistency question they may not have had to answer before. An effectiveness standard means every affiliated entity’s monitoring has to be defensible against its own documented risk profile. When one entity runs a mature, well-tuned monitoring programme and an affiliate runs a legacy rules engine nobody has recalibrated in years, that gap stops being a private operational matter and becomes a visible governance exposure the moment an examiner, or an enforcement action against one affiliate, puts the whole group’s oversight model under scrutiny.

This is precisely the dynamic that shows up in enforcement. FinCEN’s March 2026 civil money penalty against a broker-dealer, the largest ever imposed on a firm of that type, followed years of monitoring and due-diligence gaps that an effective independent testing function should have caught far earlier. An effectiveness standard turns that kind of gap from a single-entity failing into a group-wide governance question.

Signs a group’s monitoring may not hold up as one programme

Patterns like these turn a private operational gap into a group-wide governance exposure.

        Uneven maturity
One entity runs a mature, well-tuned programme while an affiliate relies on a legacy rules engine nobody has recalibrated in years.

        Unrelated rules engines
Each business line runs its own alert logic and risk-scoring methodology, even where the underlying risk is comparable.

        Dispositions without reasoning
The case trail records the outcome of an alert but not the reasoning behind it.

        Undocumented resourcing
Resource allocation decisions are not documented well enough to survive an effectiveness review.

What “effective” will actually be tested against

The proposed rule is specific about what independent testing needs to demonstrate. Testing must be based on objective criteria that assess whether the institution has effectively established, implemented and resourced its programme consistent with its own risk assessment, and it must be performed by parties who are genuinely independent of the AML/CFT function itself. For banks, FinCEN has also signalled that using innovative tools, including AI-assisted monitoring, to demonstrate programme effectiveness is one of the factors it may weigh in supervisory and enforcement decisions.

In practice, that raises the evidentiary bar. It is no longer enough to show that alerts are generated and cleared. An institution needs a documented line from its risk assessment, through its monitoring rule set, to the outcomes that monitoring produces, and it needs testing that can independently verify that line holds.

Area

What the proposal looks for

Evidence expected

Risk assessment

Resource allocation informed by, and consistent with, a reasonably designed risk assessment.

Documented

Independent testing

Objective criteria showing the programme is effectively established, implemented and resourced, performed by genuinely independent parties.

Independent

Monitoring outcomes

Monitoring that surfaces genuine suspicious activity rather than alerts that lead nowhere.

Outcomes

Innovative tools

For banks, use of innovative tools, including AI-assisted monitoring, to demonstrate effectiveness may be weighed.

Weighed (banks)

Building a monitoring architecture that can prove itself

For enterprise risk leaders, the practical response is architectural rather than purely procedural. FraudShield, Nexiant’s specialist transaction-monitoring brand, focuses on real-time detection, configurable rule logic and case-management workflows designed to produce the kind of documented, auditable trail an effectiveness-based exam expects, rather than a rules engine tuned once and left alone.
