India received significant remittance inflows historically, with the Gulf states as a major source. India is also a major trade partner of the UAE, with bilateral trade covering petroleum products, gold, textiles, machinery and agricultural products. The UAE functions as India&#8217;s principal gold import source, and gold trade between the two countries constitutes a significant component of bilateral commerce.<\/p>\n<p>The Indian diaspora in the Gulf is substantial, with large communities in the UAE, Saudi Arabia, Qatar, Kuwait and Oman. The remittance behaviour of these communities, combined with the trade activity between the two regions, creates a complex financial environment that straddles formal banking channels, licensed exchange houses and informal value transfer systems.<\/p>\n<p>India&#8217;s Prevention of Money Laundering Act (PMLA), 2002, as amended, establishes the domestic legal framework for anti-money laundering obligations in India. Enforcement of PMLA is led by the Enforcement Directorate, which investigates money laundering offences and pursues asset recovery. The Financial Intelligence Unit of India (FIU-Ind) receives suspicious transaction reports from reporting entities and disseminates intelligence to law enforcement agencies. India&#8217;s AML framework has been progressively strengthened, including through amendments to PMLA that have expanded the scope of predicate offences and enhanced enforcement powers.<\/p>\n<p>The FATF Recommendations provide the international framework within which India&#8217;s AML regime operates. India is a member of the FATF and underwent a mutual evaluation that assessed the effectiveness and technical compliance of its AML\/CFT system.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Hawala_in_the_India-GCC_Corridor\"><\/span>Hawala in the India-GCC Corridor<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Hawala remains a significant feature of the India-Gulf remittance corridor. The system offers speed, accessibility and competitive pricing for migrant workers sending remittances to families in India, and the hawala network operating between the Gulf states and India has been in place for decades. For compliance purposes, the challenge is distinguishing between the legitimate use of hawala by low-value remitters and the exploitation of hawala channels to launder proceeds of crime or to move funds for terrorist financing purposes.<\/p>\n<p>The FATF MER UAE 2020 identified hawala and alternative remittance as presenting significant money laundering vulnerabilities in the UAE context.
